Overview
The Town of Easton is proposing a text amendment to Chapter 28 of the Town of Easton’s Code (Zoning Code) which would refine the current Mobile Food Service Pilot program and amend the Zoning Code to a more permanent program. The pilot program was originally set to expire on May 2nd. However the Town Council believes that it will have better data to make permanent amendments if the pilot program runs through the summer season, thus it is proposed to be extended to September 2nd, 2026.
Mobile Food Use in the Zoning Code is defined as “a food service operation that is vehicle-mounted or wheeled, a portable structure, or a watercraft that is capable of being readily moved. Uses that are similar in nature but do not meet this definition, such as trailer without wheels, are not considered a mobile food use and therefore would be subject to the applicable use and building regulations for the appropriate fixed structure.”
Background
- On September 2nd, 2025, the Town Council passed a resolution(Resolution No. 6217) to establish a pilot program for Mobile Food Uses
- The Town Council extended the pilot program to September 2nd, 2026
- Mobile Food Uses need to obtain a Mobile Food Use license to operate within the Town of Easton. There is a $250 fee to obtain a Mobile Food Use license during the pilot program
- The extension to the pilot program’s duration was approved in order to allow the Town Council to formulate permanent amendments to the program
- The pilot program establishes guidelines for licensing requirements and restrictions regarding places of operation
Resolution No. 6217
Under the resolution:
- The Town Council extended the pilot program to September 2nd, 2026
- Mobile Food Uses that are for a specific private event on private property are exempt from the requirements to get a Mobile Food Use license
- Mobile Food Uses shall obtain any required State of Maryland or Talbot County licenses/and or permits and provide proof to the Town with submission of the license application
- Mobile Food Uses are not permitted to operate on Property owned by the Town of Easton or within public rights of way unless approved in conjunction with a Public Assembly Permit
- Mobile Food Use Units may not remain in the same location for a period exceeding 24 hours, but may move between approved locations
- Mobile Food Use Units may not be within 300ft of the entrance of an existing operating restaurant
- Mobile Food Uses are only permitted to operate on private property excluding property within the Central Business District
